I don't know - but it brings to mind a David Allen Cole song - something about - "this will only hurt for a lil' while".
Herding sheep? Flocks. Sorry, as a kid growing up in Brooklyn, I've always associated this with lil' Miss Muffet. Who exactly made the jump association to cowboys? I don't get it.
For anyone who knows what its like to spend weeks "in the field" - we have a tendancy to keep our distance from one another - preferrably upwind. The image of embracing under those circumstances is disturbing enough - and that is with a woman - my cat might like it though.

Google Loses Copyright Infringement Case
(Los Angeles) Google will be prevented from displaying certain copyrighted thumbnail images according to a U.S. District Court ruling on Friday.
From Breitbart.com:
Internet giant Google Inc. infringed copyright rules by posting thumbnail-size photos from other websites on its search results pages, a US judge said in a ruling issued.
US District Judge Howard Matz's ruling, handed down in Los Angeles, stems from a lawsuit filed in 2004 by the pornography firm Perfect 10 Inc., which accused Google of breaching on its copyrights.
The type of search with which Perfect 10 took issue is Google's "Image Search" function, which returns a page with tiny images -- known as thumbnails -- that fit the searcher's query.
The image search function also allows searchers to view the image as it appears on the page.
The judge ruled that because Google receives advertising money from offering search functions, it is not entitled to the same level of free use of the images as other entities would be.
Both sides in the case were instructed to craft the wording for a preliminary injunction barring Google from using the thumbnail-size images. Notably, the ruling applies only to images owned by the Perfect 10 company. For now, that is.
As the godfather of search engines, I would speculate that Google will be taken to court on a fairly regular basis.

This is one fascinating and wacky case - and another good reason why lawyers should be shot.
A search engine is in a way like a Yellow Pages - this is how people find you and do business.
With Yellow Pages you pay to be listed - with search engines your listing is free - the engine gets revenues from general advertising and priority listings.
Goggle can now (if they want to be a prick and now go for the really big money) - drop the image feature and look for ways to delist/block virtually everybody (especially businesses) from appearing on a search - unless the pay something for the privilage of being listed. They already have a system to prioritize listings.
I'm gonna love to see how this plays out.
Posted by: hondo at February 23, 2006 12:43 PM (fyKFC)
2
Well, the difference is, people request to be put in the yellow pages, I believe. They did not request to be put on google - so if they wish they can sue to remove their listings from there.
If google wishes, they can offer an all-or-nothing deal. That is what I would do in their place if I thought I could get away with it - either we get to show your images or your website just won't be listed.
Posted by: MiB at February 23, 2006 01:32 PM (tFcEO)
3
Agreed. If they can get away with that - then I would invest the farm on Goggle!
Interesting circle! You request to be put in the yellow pages in order to be found and do business - a business goes on the net to do what? Be invisible? Unlisted?
Its actually a funny suit - rates up there with warnings for coffee cups - contents can be hot.

You can choose to be on google or not, there are numerous ways from embedding:
meta name="robots" content="noindex, nofollow" in headers or creating a robots.txt in your web root with
User-agent: googlebot
Disallow: *
inside, which would tell google to not crawl.
You could also use the apache module mod_rewrite to ensure that the HTTP_REFERRER string is set to your domain on images (which is how most sites protect themselves from hotlinking) you would specifically have to allow images.google.com to crawl.
As usual some seventy year old incontinent judge that cannot even use AOL, listened to this company try and hit a home run for cash and has no clue this company could have prevented google from not only coming to their page, but also stop them making thumbnails of their images.
Typical.

Whoa! Good info - I wasn't aware how easy it would be with a good IT man. This company must be some nickel and dime operation or hustlin' for a quick buck.
Why a company would want to go on the net for sales, then turn around and not want to have customers linked to them by a search engine is freakin' absurb! Think you nailed it with the judge!

WTW WhoÂ’s The Enemy?
I’ve heard some talk lately about the “authoritarian cult”. That’s not referring to the death and destruction of Islam, but to our President and His supporters by our own beloved “Left” right here at home. It’s been said that a requirement of the Right is to blindly follow George W. Bush or for the Left to hate him. The terrorists share your hatred of Bush but lets face it after that they pretty much call America the Great Satan and then cite issues that may be considered traditional Democratic or Leftist issues as not compatible with Islam or outright crimes worthy of the death penalty. They include Women’s rights, civil Rights, Equal treatment based on religion, Humane Punishment and Gay rights. Must I go on! The list is endless when you think about it. We on the Right or moderates among us are not authoritarian at all. In fact we have been fighting for the left’s right to fight for their issues too. For instance see how the religion of peace stopped Gays from marching in Russia.

DU SCANDAL EXPLODES
http://www.freemarketnews.com/WorldNews.asp?nid=8018
Tuesday, February 21, 2006 - FreeMarketNews.com
“The Preventive Psychiatry Newsletter has written to its subscribers telling them that the real reason the former Veterans Affairs Secretary, Anthony Principi, recently resigned was because he has been involved in a massive scandal covering up the fact that Gulf War Syndrome was caused by the use of depleted uranium, according to the SF Bay View.
In the article Arthur Bernklau, executive director of Veterans for Constitutional Law, reportedly wrote that “thousands of our military have suffered and died from, [and depleted uranium] has finally been identified as the cause of this sickness, eliminating the guessing. The terrible truth is now being revealed.” Bernklau went on to detail several alarming statistics. The historical disability rate amongst soldiers last century was about 5 percent, although it approached 10 percent during Vietnam. But due to the use of depleted uranium in the battlefield, 56 percent of the 580,400 solders that served in the first Gulf War were on Permanent Medical Disability by 2000. 11,000 Gulf War veterans are already dead. Now 518,739 Gulf War Veterans, almost all of them, are currently on medical disability.
Principi, under the order of the Bush Administration, had been allegedly covering up the disastrous results of using depleted uranium since 2000. However, with so many soldiers having serious health problems it has become impossible to keep secret.”

"depleted uranium" is a Leftist hoax. We've already covered that at length here. Don't make me prove you wrong yet again. And spare me a repeat of the Gooogle quotes. My Google quotes kicked your Gooogle quotes' ass.
re blindly following "Bush" (I put it in quotes because in the minds of Lefties "Bush" has ceized to be the George W. Bush that exists in any real world sense. He's a boogieman that really only exists in their deranged minds), conservatives weren't so "blindly" following him when they derailed his Supreme Court nominee, nor now with the Arab port deal. Which suggests that when we support him there's nothing blind about it.

Love greg's numbers - they are of course huge! - for effect. Now how exactly would this grand conspiracy go about hiding something like that from the military community itself - vets, active & reserve personnel plus families.
Oh! I know how! Because this vast military community is freakin' stupid! that's why we must depend on the "gregs" to "protect us". See, the "gregs" know we are stupid and incompetent - and thus feel obligated to speak for us for our own good. And - if it helps them with their overall agenda - all the better.

The Blog Sabbath
Remember the Blog Sabbath, to keep it Holy. Six days thou shalt blog, but one day a week is a sabbath unto the Lord of the Blogosphere.
Just a reminder to loyal minions that I do not blog on Sunday. I call it the 'Blog Sabbath'. I'd advise other bloggers to take a day off, too. A day spent away from a computer screen. A day to recharge your batteries. A day to reconnect with family and friends. A day to remind yourself that the most important things in life are the relationships you build, and not politics.

Question to "living document" advocates
If the Constitution is a "living document" which can be changed without amendment based on current social needs, then why did the Founders
write it down? The British had (and still have) a 'living Constitution' that wasn't written. Surely if they believed the Constitution was 'flexible' then they would have adopted the British model, wouldn't they?
Danny has more on living document Constitutionalism.

The "living document" theory of the Left is just that, a theory. It is obvious that the Founding Fathers never intended for the Constitution to be changed by the Courts, or why would they have put a mechanism in the Constitution that allows for change.
This is just another tactic used by the Left to USURP the Constitution of the United States of America, and it is illegal, no matter what the Left says. We should never have allowed change without using the mechanism for change that exists in the Constitution. And we should allow no more.

>>>...or why would they have put a mechanism in the Constitution that allows for change.
There is a mechanism by which the Constitution can be changed-- it's called ammendments. But that process requires popular support-- something the Left has zero hope of ever achieving. Thus their whoring it out to sympathetic judges.

Carlos,
I hear the Left constantly complaining about Congress giving up its power to the Executive Branch, but in truth the Congress has given up the majority of its power to the Judicial Branch.
The Judicial Branch is constantly making law that cannot gain the majority in Congress. This is wrong and is where the Congress has given over even its powers of budget making and taxation.
When a federal judge makes another obviously unconstitutional decision, the Congress has the power to remove that judge from office, but how many times has the Congress used that power? The unilateral power grap by the federal judiciary is the least reported event of the last century.

Only 2 of the current supreme court were appointed by democrats. Most people in polls no longer would support even the Bill Of Rights. For instance on the matter of bail for the presumed innocent the founding fathers were rather unambiguous on this matter. For certain they all had grave concerns about empowering the central federal government with too much power. Powers already granted to a "good" executive branch would be difficult to control in a "bad" executive branch. Even if we are certain that this power will be wisely used now who knows about the next regime ?

Since "perfection" is a lofty and unattainable goal - you have two choices. a "living" constitution subject to the often whims of societal change that fluctuate like the winds - or a contitution written with an ammendment process designed to be demanding and difficult.
I'll take #2
John - I can't make any sense out of what you said!

I have fun asking lefties if the Constitution is still a "living document" whenever they start complaining about Bush or the courts doing something they think is unconstitutional.

Based on what I know about Arab culture, wouldn't Mohammad Brand shoe liners ("Mo-dor Eaters!") be an even more grieveous insult?

This reminds me of the news story several years ago where people were coming from all over the country to see the image of Jesus slowly beginning to appear on the side of a wall here in Texas - near Austin or San Antonio I think. People flocked to town for about week before someone remembered that there had once been a painting on that wall advertising Willie Nelson's Fourth of July concert and the old image was bleeding through the newer layers of paint. Even as a devout Christian, I never get tired of hearing of people standing in line for hours to see images of Jesus or Mary in reflections of glass or tortillas. I feel pretty comfortable with my knowledge that if Jesus were going to give me a sign, it would be something a bit more profound than some flat bread. I wonder if poor people in India ever see Vishnu or Ganesh on a plate of naan.

I didn't even try to go out and find Jesus in a pancake but it came to me anyway.
If you look long enough, it's kind of like those hidden pictures at the mall kiosk. He's got this listed on ebay and will probably make a couple of thousand off of it.

Google's Blog Censorship Hypocrisy
I've contacted Google (which owns Blogger and .blogspot) about dozens of terrorist websites run from .blogspot accounts. They have NEVER taken down those largely Arabic websites advocating the murder of Jews and Christians, yet, if you go to
The Study of Revenge website which lampoons Islam they feel it necessary to warn you of offensive material. So, first Google caves to the Chinese and then they cave to thin-skinned Muslims.

I wonder if this isn't also a thinly disguised shot across the bow to other Blogger blogs that criticized the censorship of Google China?

So what are the addreses of these terrorist websites? You know Google, unless it's got a high hit count, it doesn't count.
So lets get together and flag these sites... a lot. I suspect that is what happened at The Study of Revenge.
